- Defendant First Choice Payment Solutions G.P. d/b/a Sekure Merchant Solutions (“Defendant”) has agreed to pay six million two hundred and fifty thousand dollars ($6,250,000) into a fund from which eligible persons or entities who file claims will receive cash awards, estimated to be approximately $30 per claim.
- The settlement resolves a lawsuit involving allegations that Defendant made telemarketing calls from July 26, 2013 through February 1, 2018 on cellular telephone lines using an automatic telephone dialing system or artificial or prerecorded voice.
- Court-appointed lawyers for the class (“Class Counsel”) will ask the Court for two million eighty-three thousand three hundred and thirty-three dollars ($2,083,333) of the fund as attorneys’ fees for the time the spent investigating the facts, litigating the case, and negotiating the settlement. Class counsel will also ask the Court to reimburse them an additional $19,250 for the out-of-pocket expenses they incurred in pursuing the case.
- Defendant denies all allegations of wrongdoing in the lawsuit. As part of the proposed settlement, Defendant does not admit to any wrongdoing and continues to deny the allegations against them.
- The two sides disagree on whether Plaintiff and the class could have won at trial.
